A trademark is a word or combination of words, phrases, symbols and/or a combination of designs that identifies and distinguishes the source of goods of one party from those of another.
A service mark identifies and distinguishes the source of services of one party from those of another.
Reasons for Obtaining Federal Registration of a Trademark or Service Mark
1. National protection which would allow you to stop others who attempt to use or register a similar mark
2. Federally registered mark may have priority nationwide because after filing a mark application, others are constructively notified of your use of the mark. This constructive notice may be helpful to resolve conflicts when negotiating agreement(s) with businesses with similar or the same names. After five years from initial registration, a mark may become incontestable, eliminating nearly any trademark infringement defense.
3. Increased value for current or future business: a mark is an "intangible" asset that builds value of your company and may be sold with your business or when your business goes public, a trademark will add to your company's value.
4. Internet web address protection: if someone tries to register a web address (domain) that infringes on your mark, you may be able to shut down other's Internet business websites easier than without a registered mark. Thus, the registration may be important for distinguishing your Internet business where confusing similar names could direct traffic away from your web site.
5. Internet address protection: Service providers such as Google and Yahoo advertise names of companies. If your company name is "Hampton Harbor" and is very successful, your competitors may use the term "Hampton Harbor" in their advertising to divert potential or existing customers from your website. With a registered mark, you can prevent competitors from using your name and stealing customers from your site on the web.
Reasons for Registration with US Border Patrol Watch Services
After registration on the principal trademark or service mark register, your mark may be registered with border patrol services for a nominal charge.
