| A patent for an invention is the grant of a property right to the inventor (or an assignee), issued by the United States Patent and Trademark Office. In general, a term of a new patent is 20 years from the date on which the application for the patent was filed in the United States. |

| A patent confers onto an inventor or an assignee of the invention the right to exclude others from making, using, offering for sale, selling, or importing the invention in the United States. |

| In the United States, an inventor has one year from the date of public disclosure, use, or sale of your invention to file a patent application, e.g., utility, design, plant, or provisional, with the United States Patent and Trademark Office. |

| Once a patent is issued, the patentee must enforce the patent without aid of the USPTO, e.g., pay maintenance fees . . . |

| Types of Patent Protection |
| 1. Utility patent granted to inventor discovering any new and useful process, machine, article of manufacture, or composition of matter, or any new and useful improvement thereof; |
| 2. Design patent granted to inventor for a new, original, ornamental design for an article of manufacture. |
| 3. Plant patent may be granted to anyone inventing or discovering and asexually reproducing any distinct and new variety of plant. |
